Under New Jersey law, a referral agent is officially designated a Salesperson Licensed with a Real Estate Referral Company (SLWRERC). This license type was established effective July 1, 2011 under the NJ Real Estate License Act.
A referral agent is a licensed real estate professional whose brokerage-related activities are strictly limited to referring prospective consumers of real estate brokerage services to their supervising broker. All other real estate brokerage activities are prohibited.
The supervising broker — in this case Hallmark Realtors — then places the referral with the appropriate full-service agent or team within our network, including our LeadingRE affiliate network for out-of-area referrals.
To become a licensed referral agent in New Jersey, you must already hold or obtain a NJ real estate salesperson or broker license. There is no separate referral-only exam or course.
No continuing education is required for referral agent license renewal under current New Jersey law. This is a significant advantage over maintaining an active salesperson or broker license, which requires 12 hours of CE every two years.
You must renew your referral agent license every two years, with the biennial renewal deadline of June 30 of each odd-numbered year (next renewal: June 30, 2027). The state renewal fee is approximately $100 for a salesperson-level license.
At each renewal, the supervising broker (Hallmark) is required by the NJREC to certify that the restrictions on referral agent activity have been reviewed with you and that you have acknowledged awareness of those restrictions. Hallmark handles this certification on your behalf.
New Jersey Real Estate License Act, N.J.S.A. 45:15-1 et seq.; N.J.A.C. 11:5-3.15. Always verify current fee amounts and renewal deadlines directly with the NJ Real Estate Commission at nj.gov/dobi.
Referral agents may only refer prospects to the broker through whom they are licensed — that is, Hallmark Realtors. You cannot refer clients directly to another broker or agent, even if you know them personally.
In practice: you bring the lead to Hallmark, and Hallmark places the client with the right agent. When the transaction closes, your referral fee is paid by Hallmark. This structure protects both you and your clients.
One important clarification: under N.J.A.C. 11:5, if Hallmark authorizes it, you may refer prospects to another licensee — but you must provide written or electronic notice to Hallmark at the time of the referral, and compensation must still flow through Hallmark.
If you want to return to full-time sales practice in the future, you can convert your referral license back to an active salesperson or broker license. The CE requirements depend on how long you've been a referral agent:
