What exactly is a NJ real estate referral agent?
A New Jersey real estate referral agent — officially called a Salesperson Licensed with a Real Estate Referral Company (SLWRERC) — is a licensed real estate professional whose activity is restricted to referring prospective buyers and sellers to their supervising broker. At Hallmark, we call this role a Hallmark Referral Associate. You hold an active NJ real estate license, you earn commissions on referrals, but you are not required to list properties, show homes, or complete continuing education.
Do I need to complete continuing education to maintain my referral license?
No. Under current New Jersey law, referral agents are explicitly exempted from the continuing education requirement that applies to active salesperson and broker licensees. Active licensees must complete 12 hours of CE every two years; referral agents have no such requirement. You must simply renew your license every two years by the June 30 deadline and pay the state renewal fee (approximately $100).
I'm already a licensed NJ salesperson. How do I become a Hallmark Referral Associate?
The process is straightforward: (1) complete our short application form below, (2) we initiate the license type change and transfer through the NJ REC online system, (3) we review the legal restrictions with you as required by the NJREC and execute your Independent Contractor Agreement, (4) your license is live under Hallmark and you can begin referring clients. The typical state fees are $50 for the license type change and $25 for the transfer to Hallmark. We'll walk you through every step.
What happens if my NJ license has lapsed?
If your license has lapsed but is within the two-year reinstatement window from the expiration date, you can reinstate your license and simultaneously convert to referral agent status. The state reinstatement fee is approximately $150. If your license has been expired for more than two years, you would need to retake the pre-licensing education and exam as a new applicant. Contact us and we'll help you determine exactly where you stand.
Can I refer clients to any agent or broker I know?
Not directly. Under NJ law, a referral agent may only refer prospects to the broker through whom they are licensed — Hallmark Realtors. You cannot refer a client directly to another broker or agent, even a personal contact. You bring the lead to Hallmark; Hallmark then places the client with the most appropriate agent, including out-of-area placements through our LeadingRE network. All compensation flows through Hallmark to you. There is one exception: if Hallmark authorizes a specific direct referral, you must provide written notice to Hallmark at the time the referral is made.
How much will I earn on a referral?
Referral fees are typically 20–30% of the cooperating agent's commission at closing. On a $600,000 home sale with a 2.5% buyer's agent commission ($15,000), a 25% referral fee yields $3,750. There is no limit on the number of referrals you can make per year, and no cap on earnings. Hallmark will provide you with our current Hallmark Referral Associate fee schedule during the application process.
Can I return to active real estate sales later if I want to?
Yes. A referral license is not permanent. If you decide to return to full active sales practice, you can convert your license back to salesperson or broker status. The amount of CE required to do so depends on how long you have been a referral agent: less than 6 years requires core CE topics only (exam not required); 6 or more years requires additional CE and potentially the exam. See N.J.A.C. 11:5-3.15 for the current requirements. Hallmark will fully support your return to active status when the time comes.
Can I hold a referral agent license and a full salesperson license at the same time?
No. Under NJ law, no person may simultaneously hold a referral agent license and an active salesperson, broker-salesperson, or broker license. The referral agent license type replaces your active license for the period you operate as a referral agent. You may only be licensed with one broker at a time as a referral agent.

What Is a NJ Referral Agent?

Under New Jersey law, a referral agent is officially designated a Salesperson Licensed with a Real Estate Referral Company (SLWRERC). This license type was established effective July 1, 2011 under the NJ Real Estate License Act.

A referral agent is a licensed real estate professional whose brokerage-related activities are strictly limited to referring prospective consumers of real estate brokerage services to their supervising broker. All other real estate brokerage activities are prohibited.

The supervising broker — in this case Hallmark Realtors — then places the referral with the appropriate full-service agent or team within our network, including our LeadingRE affiliate network for out-of-area referrals.

NJREC — Licensing Requirements

How to Qualify

To become a licensed referral agent in New Jersey, you must already hold or obtain a NJ real estate salesperson or broker license. There is no separate referral-only exam or course.

  • Already licensed as NJ salesperson or broker: You qualify immediately. The process is a license type change and transfer to Hallmark. State fees are approximately $50 for the type change and $25 for the transfer.
  • New applicant with no NJ license: You must first complete the 75-hour NJ pre-licensing education course and pass the NJ salesperson exam. Once licensed, you may immediately elect referral agent status.
  • Lapsed NJ license: If your license has lapsed but is within the reinstatement window (two years from the expiration date), you may reinstate and convert to referral status simultaneously. The state fee for reinstatement is approximately $150.
NJREC — Renewal Requirements

Maintaining Your License

No continuing education is required for referral agent license renewal under current New Jersey law. This is a significant advantage over maintaining an active salesperson or broker license, which requires 12 hours of CE every two years.

You must renew your referral agent license every two years, with the biennial renewal deadline of June 30 of each odd-numbered year (next renewal: June 30, 2027). The state renewal fee is approximately $100 for a salesperson-level license.

At each renewal, the supervising broker (Hallmark) is required by the NJREC to certify that the restrictions on referral agent activity have been reviewed with you and that you have acknowledged awareness of those restrictions. Hallmark handles this certification on your behalf.

NJREC — Key Restrictions

The One Rule That Matters Most

Referral agents may only refer prospects to the broker through whom they are licensed — that is, Hallmark Realtors. You cannot refer clients directly to another broker or agent, even if you know them personally.

In practice: you bring the lead to Hallmark, and Hallmark places the client with the right agent. When the transaction closes, your referral fee is paid by Hallmark. This structure protects both you and your clients.

One important clarification: under N.J.A.C. 11:5, if Hallmark authorizes it, you may refer prospects to another licensee — but you must provide written or electronic notice to Hallmark at the time of the referral, and compensation must still flow through Hallmark.

Changing Back to Active Salesperson or Broker

If you want to return to full-time sales practice in the future, you can convert your referral license back to an active salesperson or broker license. The CE requirements depend on how long you've been a referral agent:

  • Less than 6 years as referral agent: You must complete certain Core CE topics (the exact number of hours depends on years as referral) before converting. You do not need to retake the licensing exam. See N.J.A.C. 11:5-3.15 and the NJREC chart for your specific requirement.
  • 6 or more years as referral agent: Greater CE requirements apply, and the exam may be required depending on circumstances. Contact the NJREC or Hallmark for current guidance specific to your situation.

Hallmark will fully support your transition back to active status when and if the time comes.
