What is the attorney review period in New Jersey?
New Jersey is one of the few states that requires an attorney review period after a contract is signed. Both the buyer and seller have three business days to have an attorney review the contract and either approve it, cancel it, or propose modifications. This protects both parties and is a standard part of every NJ real estate transaction. What closing costs does a seller pay in New Jersey?
NJ sellers typically pay: real estate commission, the NJ Realty Transfer Fee (Transfer Tax), any outstanding mortgage balance, prorated property taxes, and attorney fees. The NJ Realty Transfer Fee is calculated on a sliding scale based on sale price — for example, on a $500,000 home, it is approximately $1,675. Your Hallmark agent will provide a full estimated net sheet so you know exactly what to expect before you list.
What is the NJ Mansion Tax and does it affect sellers?
The NJ Mansion Tax is a 1% tax on the purchase of residential property sold for $1,000,000 or more. In New Jersey, this tax is paid by the buyer — not the seller. However, in a competitive negotiation, sellers of high-value homes should be aware that buyers may factor this cost into their offer. What do I have to disclose when selling a home in NJ?
New Jersey requires sellers to complete a Seller's Property Condition Disclosure Statement covering the condition of the home's major systems, known defects, environmental issues (such as lead paint, asbestos, or underground storage tanks), and any other material facts that could affect the buyer's decision.
